General terms and conditions for subscription contracts between subscribers and EROL Medien GmbH
1 Conclusion of the contract
The subscription contract for the regular subscription of the magazines comes about through the verbal or written order of the subscriber and the confirmation of EROL Medien GmbH. The acceptance of the delivery counts as a confirmation.
2 Subscriber Obligations
The subscriber is obliged to accept the magazine for the duration of the contractual relationship and to pay the agreed subscription price.
3 Delivery/Provision
The magazine is delivered within the month of publication. A defect in the delivery must be reported immediately by telephone or in writing. In the case of late complaints, claims for the past are excluded. EROL Medien GmbH is only liable for non-deliveries, late deliveries or damage to property in the course of delivery in the event of intent or gross negligence.
4 Term and Termination
The subscription is initially valid for a period of 12 months. It is automatically extended by a further 12 months if the subscriber does not give written notice of termination two months before the subscription expires.
The right of both parties to terminate the contract for important reasons, including without notice, remains unaffected. An important reason is default in payment or if one party culpably violates a material obligation assumed by it in this contract and does not comply with the violation within the set period despite a warning with a reasonable period of time.
5 Late PaymentAs soon as and as long as the subscriber ends up in default of payment, EROL Medien GmbH is entitled to interrupt the delivery of the newspaper. If the customer does not make payment on time, EROL Medien GmbH will remind the customer and set a deadline. If the customer ignores these warnings, EROL Medien GmbH is free to take further appropriate measures to prosecute and in particular to commission a debt collection agency to enforce the law. In addition to the outstanding purchase fees, the customer must bear all costs incurred for legal action (including reminder costs, costs for collection agencies, etc.). The assertion of further

6 changes
Changes to the delivery address or other data must be communicated to EROL Medien GmbH immediately. In the event of a move, EROL Medien GmbH must be informed of the new address.
7 Miscellaneous
Should individual provisions of these General Terms and Conditions contradict the statutory provisions and be ineffective, the rest of the contract shall not be affected. The invalid provision should be replaced by a provision that comes closest to the economic sense and purpose of the invalid provision in a legally effective manner. This regulation applies accordingly in the case of loopholes.
8 Place of Performance and Jurisdiction
Place of performance and place of jurisdiction is the registered office of the company.
9 Retention of Title
The delivered goods remain our property until full payment.
